Below is the DNS Texas disclaimer, warranty statement and Terms Of Service (TOS). This statement applies to all computers, parts and/or services (where applicable) purchased from DNS Texas that are still in the warranty period or have current maintenance contracts active. X. DNS TEXAS HOSTING/E-MAIL/SERVER GUIDELINES & SLA |
X. DNS Texas offers web hosting and e-mail services, including hosted e-mail services to qualifying customers. Although we do not monitor content, the following restrictions do apply to all hosted accounts. [Updated: OCT 2014] X.I Any website hosting illegal and/or pirated software, music and/or movies will not be tolerated and will be subject to removal with or without notice. Any legitimate software or files are allowed within your disk space allocation. Malware and other forms of malicious software are prohibited. You may not be eligible for continuing service with DNS Texas after piracy or malware related types of violation. X.II Any e-mail abuse such as unauthorized mass mailing of unsolicited e-mails (aka: SPAM) will not be tolerated and may result in termination of service. Although mass mailing is allowed, for legit reasons by customers using DNS Texas services with accounts in good standing. Virtual server cannot send e-mails out by default. You must request this ability by completing the Virtual Server E-mail Request form. We do not tolerate ‘spam’ being sent from our networks – if SPAM e-mails are detected or blacklisting of your IP occurs, your account will be suspended and may not qualify for re-activation. Be sure to check with DNS Texas sales before signing up for services if you plan to mass-mail customers. X.III Falsifying of information to sign up for services will result in termination of account privileges, including access to all major access venues including WEBDAV, VPN, FTP and WEB/E-MAIL services. The termination may also include the shutting down of web services. The account de-activation may last until positive identification is presented or until the company or individual has corrected the incorrect information. X.IV Any hosted sites that go under DDoS attacks may have firewall rules forced on them to counter-act the attacks, this fire-walling may temporarily restrict access to your hosted website(s) from certain IP addresses or IP ranges until the attack passes. This is implemented to prevent flooding of resources that may affect other sites. You will be notified if this temporary fire-walling is ever enforced on your site(s). We do not hold customers responsible for DDoS attacks. Our network engineers will block offending attackers as needed to ensure your hosted services remain available. X.V 30 days termination notice is required for hosted services that you voluntarily wish to move to another host, this allows our team time to prepare with the necessary changes needed on the DNS Texas side, as well as provides time for the new host to get you operational. If you are moving hosting due to unresolved issues, conflict, content violations, terms of service (TOS) violations or failing to provide 30 day advance notice of hosting move – a service fee may be applied to your account. (variable rate, not to exceed $150.00 USD). X.VI Failure to pay for agreed services may result in termination of access to systems, including suspension of website and e-mail accounts. Your website may switch to a “Contact DNS Texas Billing” for unresolved issues. E-mail account(s) will be inaccessible and e-mails inbound will be ‘returned to sender’ in suspension mode. You can clear these issues up and restore services by contacting DNS Texas and correcting the problem that caused suspension. X.VII Sites that become infected accidentally or sites that intentionally are injecting malware into visitors browsers via vulnerabilities are subject to immediate suspension. If the bad content was unintentional, DNS Texas support services will assist with cleanup and attempt to identify the source (fees may apply). If bad content is intentionally injected into a hosted site with the intent to cause damage, Phish information or generally cause any type nuisance, the site will be suspended pending investigation. Authorities may be notified in some extreme cases and you may be ineligible for continuing services with DNS Texas. X.VIII Pre-paid hosting accounts may be terminated and moved to other hosts provided standard 30 day notice is provided (as stated above). Refund of unused pre-paid amount will be sent to the account holders primary address, less any applicable fees. Refunds of pre-paid services are performed via company check and may take up to two weeks to process and be received by account holder. X.IX DNS Texas has an average up-time of 99.54% – our standard service level agreement (SLA) guarantees average 99.00% up time on all or our services. Certain circumstances may occasionally occur, such as weather related incidents, broken fiber optics and other more rare internet outages that may affect your hosted services and access. We will credit accounts for extended outages that qualify for credit. Certain types of outages are completely out of our control, if outage continues for more than 4 hours our emergency co-lo sites will be brought up as primary sites to restore base services. Service credits may apply to all customers in this case. Credits for SLA are handled case-by-case. X.X Servers. DNS Texas offers both virtual and dedicated servers for lease on a month to month basis. We screen all applicants requesting dedicated and virtual servers and may deny the request based on screening results. Dedicated and virtual servers may not be used in BOT activities, for SPAM related activities or any other malicious reason. Failure to abide by these rules will result in termination of your server with or without warning. Cancellations should be requested at least (7) days before your bill is due, failure to notify of a cancellation request may result in being billed an additional month, which will be not be refundable. We reserve the right to terminate any server that is deemed malicious for any reason. Unless specifically stated, you are fully responsible for your own data backups. DNS Texas can provide backup services if needed, at additional cost. We fully maintain dedicated server hardware and replace/repair as needed – this includes motherboard, memory, hard drive, etc. Refunds are not issued for server hosting, please be sure you have contacted DNS Texas Sales and had all questions answered BEFORE purchasing any server based hosting services. This is to ensure we can provide the requested services and that you fully understand the responsibility of using a dedicated or virtual server on our network. We do not accept PayPal for server hosting due to former issues. Server hosting must be paid for via credit card. Addendum to section X.X – Appended January 2017 : Remediation and cleanup of damaged IP addresses due to abuse may incur additional fees to un-blacklist and/or replace. These fines are charged $24.95/per IP address, per incident. X.XI Bandwidth. DNS Texas hosted services are provided, by default at up to 100mbps. If you require additional bandwidth, you may request it at the current market rate of $4.00/mb – requests must be made in 25mb increments. Bandwidth upgrade requests are only honored for trusted customers who have had services with DNS Texas in the past and/or for 30 consecutive days with no issues. X.XII IP Addresses. DNS Texas, by default, hosts most services on shared IP addresses, meaning many services may utilize the same IP address but use different TCP or UDP port numbers. We attempt to keep all major services on their own IP addresses. Customers may request dedicated IP address(es) for their services in minimum blocks of (8) addresses. The current market cost per IP address is $3.00, each 8 block added will incur additional monthly fees of approx $24.00. IP address blocks requested in quantities under 16 are typically processed and available within (5) business days. Larger blocks may require a slight amount more time while IP address justification forms are completed and processed. Dedicated IP address requests are only honored for trusted customers who have had services with DNS Texas in the past and/or for 30 consecutive days with no issues. Temporarily, we offer up to a single external, dedicated IP to get you started. X.XIII Archives & Usage. You may use your site for archiving, data storage, FTP, etc. You should keep in mind that web sites are typically public and sensitive data should NOT be stored on your website, even if secured with username/password. We offer proper secure backups that encrypt data and allow you non-public facing access (more info).
